Welcome to AI on-Demand! These Terms and Conditions (“Terms”) govern your access as a user (“User”) and use of the AI on-Demand platform (“Platform”), including any content, functionality, and services offered on or through AI on-Demand (collectively, the “Services”).
Please read these Terms carefully before using the Services.
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Services.
1. Access to the Services
1.1 Eligibility: By accessing or using the Services, you affirm that you are at least 18 years old or have reached the age of majority in your jurisdiction. You confirm that you are fully able and competent to enter into the terms, conditions, obligations, representations, and warranties set forth in these Terms and to comply with them.
1.2 Accounts: To access certain features of the Services, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
2. Use of the Services
2.1 License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for personal or internal business purposes. Use may be restricted or suspended for administrative, operational, or security reasons without prior notice or compensation.
2.2 Acceptable Use:
You agree not to use the Services in any unlawful or prohibited manner. This includes but is not limited to:
- Damaging, disabling, overburdening, or impairing the operation or appearance of the Services.
- Interfering with others’ use of the Services.
- Using Services in an illegal manner.
- Uploading, submitting, or transmitting illegal content.
- Attempting unauthorized access to any part of the Platform, its Services, or any other systems or networks connected to the Services.
You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so):
- You may not use the Services to do or share anything:
- That breaches these Terms or other terms and policies that apply to your use of the Services.
- That is unlawful, misleading, discriminatory, or fraudulent (or assists someone else in using the Services in such a way).
- That you do not own or have the necessary rights to share.
- That infringes or violates someone else’s rights, including their intellectual property rights (such as by infringing another’s copyright or trademark), unless an exception or limitation applies under applicable law.
- You may not upload viruses or malicious code to the Platform.
- You may not access or collect data from the Platform using automated means (without our prior permission).
- You may not proxy, request, or collect usernames or passwords from the Platform, or misappropriate access tokens.
- You may not misuse any reporting, flagging, or dispute channel, such as by making fraudulent, duplicative, or groundless reports.
This is a non-comprehensive list of prohibited conduct. User accounts may be restricted, suspended, or disabled for conduct that violates these provisions.
3. Data and Privacy
3.1 Data Ownership: You retain ownership of any content (e.g., AI resources, datasets) you upload, submit, or transmit through the Services (“User Content”). We do not claim ownership of User Content.
3.2 Data Protection: We are committed to protecting your privacy and personal data. Our Privacy Policy explains how we collect, use, and disclose information about you. By accessing or using the Services, you consent to the collection, use, and disclosure of your information in accordance with our Privacy Policy.
3.3 GDPR Compliance: By uploading, submitting, or transmitting any content (“User Content”) through the Services, the User confirms that such User Content is collected, processed, and shared in full compliance with all applicable data protection and privacy laws, including the EU General Data Protection Regulation (GDPR). This includes that the User has a valid legal basis to share or process any personal data and that the User Content does not violate any third-party rights and does not require the Platform or its Services to process personal data in a manner that would breach the GDPR or other applicable laws.
The Platform reserves the right to remove or disable access to any User Content that it reasonably believes may violate this clause or applicable data protection laws.
4. Intellectual Property
4.1 Scope of Protection: The Platform and all its content (text, graphics, logos, images, audio, software, etc.) are protected under copyright, trademark, patent, and other intellectual property laws.
4.2 User-Generated Content: Users retain ownership rights to their content (“User Content”). However, by uploading, submitting, or transmitting content, you grant the Platform a worldwide, royalty-free license to use, distribute, modify, and display the content in connection with the Services.
4.3 Licensing models: User content can be shared under a wide variety of different licenses (e.g., GPL, APACHE, LGPL, MIT, COMMERCIAL) or with any other officially approved license model provided as free text. Metadata for uploaded resources is made open under Creative Commons Public Domain Dedication (CC 0) or equivalent (to the extent legitimate interests or constraints are safeguarded), in alignment with FAIR principles.
4.4 IP Compliance: Users confirm that they possess all necessary rights in uploading, submitting, or transmitting content.
4.5 Third-Party Content and Collaborations: The Platform respects the IP rights of third parties. When integrating or using external data, services, or content, agreements will ensure all parties’ IP rights are observed and protected.
4.6 Innovation and IP creation: Innovations (e.g., AI models or datasets) created using the Platform are owned by the Users who develop them. The Platform may hold a license to use such innovations as per this agreement.
5. AI Act Compliance
By uploading or providing any content, data, or instructions to the Services (“User Content”), you confirm that your use of the Services complies with the EU AI Act and other applicable laws. This means you:
- Use the Services only for lawful purposes and do not deploy outputs in ways the AI Act prohibits.
- Provide accurate and lawful data and do not submit content that would cause the Service to be used for high-risk or restricted uses without the required controls.
- Meet any obligations that apply to you under the AI Act, including transparency, human oversight, risk management, or record-keeping requirements when relevant to your use case. Where users access or use AI models for non-personal purposes, they may be considered deployers under the AI Act and should ensure compliance with any additional applicable obligations under that Regulation.
- Do not attempt to circumvent safeguards or use the Services to build or operate systems in violation of the AI Act.
The Platform may limit or suspend access to the Services if we believe your use violates these rules.
6. Reporting Illegal Content (DSA Compliance)
The Platform maintains a flagging system that allows anyone to report content they believe is illegal under EU law, including violations of intellectual property rights, data protection rules, the AI Act, or other applicable regulations, such as those relating to hate speech, discrimination, or fraud, among many others. This flagging system applies to both the Forums and the AI Catalogue. When a report is submitted with the required information, the Platform commits to review it in a timely, diligent, and non-arbitrary manner. If content is confirmed to be illegal, appropriate action will be taken, which may include removal, restriction, or other measures permitted by law. Clear notice of the decision will be provided to the person who submitted the report and, where required, to the User who provided the content.
7. Security
7.1 Responsible Vulnerability Disclosure: We value the security and integrity of our systems and data. If you discover any vulnerabilities, weaknesses, or potential security threats within our systems, we encourage you to report them to us promptly and responsibly. Your cooperation helps us to promptly address any issues and enhance the overall security of our Services.
When reporting a vulnerability, we ask that you provide us with sufficient information to understand the nature and potential impact of the issue, including detailed steps to reproduce the vulnerability, if possible. Please refrain from disclosing any information about the vulnerability or exploiting it for any purpose other than to assist us in improving our security measures. Please delete all personal, sensitive, or confidential data obtained through the vulnerability immediately after it has been resolved.
To report a vulnerability or security concern, please contact info@aiod.eu. We take all reports seriously and will work diligently to investigate and address any issues in a timely manner. By participating in responsible disclosure with us, you agree to comply with these Terms and any additional instructions provided by our security team. We will treat your report confidentially, and we will not share your personal information with third parties without your permission, unless this is necessary to comply with a legal obligation. Reporting can be performed using a pseudonym.
7.2 Third-Party Vulnerabilities: If vulnerabilities are discovered that relate to third-party resources shared on the Platform, but which do not relate to the Platform itself, we encourage you to reach out directly to the entity that shared the resource to notify them of the vulnerability, in accordance with any policies that they may have.
8. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, the Platform disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, noninfringement, and title.
9. Limitation of Liability
Nothing in these Terms is intended to exclude or limit the Platform’s liability for death, personal injury or fraudulent misrepresentation caused by our negligence, or to affect your statutory rights.
To the fullest extent permitted by applicable law, the Platform is not liable for:
- any indirect, incidental, special, consequential, or punitive damages, or
- any loss of profits or revenues, whether incurred directly or indirectly, or
- any loss of data, use, goodwill, or other intangible losses,
resulting from:
- (a) your access to or use of or inability to access or use the Services;
- (b) any conduct or content of any third party on the Services; or
- (c) unauthorized access, use, or alteration of your transmissions or content.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Ireland, without giving effect to any choice or conflict of law provision or rule.
Any dispute relating to these Terms or the Services will be resolved under the Rules of Arbitration of the International Chamber of Commerce, by one or more arbitrators appointed under those rules.
11. Changes to the Terms
The Platform reserves the right to modify or revise these Terms at any time. All changes are effective immediately upon posting and apply to all access to and use of the Services thereafter. Your continued use of the Services indicates that you accept and agree to the revised Terms.
